Privacy policy

1. Definitions and Interpretation

1.1 In this privacy policy, unless the context otherwise requires:

Allied, us, we or our means Allied Petroleum Limited.

Customer means the person who purchases Products from Allied.

Mobil means Mobil Oil New Zealand Limited.

Product means fuel, lubricants, and/or any other goods supplied by Allied to the Customer.

User, you or your means all users of the Website and/or Web Portal. For the avoidance of doubt, Users include Customers who use the Website and/or Web Portal.

User Account means the account of a person who has registered to access and use the Web Portal on behalf of the Customer.

Website means Bulk fuel solutions supplier NZ | Onsite fuel delivery - Allied Petroleum.

Web Portal means Allied’s web portal which allows a person who has a User Account to access and use the web portal in accordance with Allied’s Web Portal Terms of Use.

Services means the services provided by Allied including (without limitation):

(a) the supply of Products; and

(b) providing access to the Website and Web Portal.

2. Outline of this Privacy Policy

2.1 This privacy policy will help Users to understand:

(a) This privacy policy does not limit or exclude any rights that a User has or may have under the Privacy Act 2020 (Privacy Act).

(b) how and why Allied collects information;

(c) how that information is stored;

(d) how they can access and correct that information; and

(e) when we might disclose information to other people.

2.2 This privacy policy does not limit or exclude any rights that a User has or may have under the Privacy Act 2020 (Privacy Act).

3. Application of this Privacy Policy

3.1 This privacy policy applies to all instances in which personal information is collected from a User by Allied.

3.2 By using the Services each User consents to the collection, use, disclosure, storage and processing of personal information in accordance with this privacy policy.

4. Changes to this Policy

4.1 Allied may change this privacy policy by uploading a revised privacy policy to its Website.

4.2 All Users agree to be bound by the privacy policy that is in effect at the time they use the Services.

5. Collection of Personal Information

5.1 Allied may collect the following personal information from Users:

(a) Name and email address.

(b) Place of employment or business.

(c) Any communication with Allied either directly, via phone or email.

(d) Information about the User and/or Customer obtained by or submitted to Allied through a:

(i) User’s use (or prospective use) of the Services.

(ii)Customer’s credit account application for the purchase of Products.

(e) Phone number and residential address.

(f) Gender, date of birth and job title.

5.2 Allied does not collect any other personal information about its Users, including details about any User’s race, ethnicity, religious beliefs, sexual orientation, political information or any other genetic or biometric data.

5.3 Allied may supplement the information provided to it with information it receives from third parties.

5.4 If any User chooses not to provide information when we ask for it, that User may not be able to use the Services.

6. Use of Personal Information

6.1 The information that Users provide to Allied may be used by Allied:

(a) to verify the identity of the User;

(b) in connection with the provision (or potential provision) of the Services to the User;

(c) to communicate with Users in relation to the Services;

(d) to market our Services to Users, including contacting Users electronically (for example, by text, email or an online messaging platform);

(e) to undertake credit checks of any User (if necessary);

(f) to invoice any User and to collect money that a Customer owes to us, including authorising and processing credit or debit card transactions;

(g) for database management, analytics, backup saving and management;

(h) to respond to communications from a User, including enquiries, feedback, complaints and requests via the Web Portal;

(i) to co-operate with any government, industry, legislative or regulatory authorities;

(j) to protect and/or enforce our legal rights and interests, including defending any claim; or

(k) for any other purpose authorised by a User and/or the Privacy Act.

6.2 Allied reserves the right to use data (on an anonymous basis) and data in relation to a User’s use of the Services for marketing and accounting purposes.

7. CCTV

__________________________________________

7.1 This clause 7 applies to Allied’s use of Closed Circuit Television cameras and their footage (CCTV Systems).

7.2 Allied operates CCTV cameras at its fuel stop sites above each fuel pump. The CCTV cameras operate 24 hours a day to capture the arrival, refuelling process and departure of each Customer. Camera locations are chosen to minimise viewing of spaces not relevant to the legitimate purpose of the monitoring. As far as practically possible, CCTV cameras will not focus on private homes, gardens or other areas of private property.

7.3 The CCTV cameras record images only, including images of Customers and licence plate numbers. We will ensure that signs are displayed near where the CCTV Systems are operating and at each entrance of our fuel stop sites to alert people that they may be recorded.

7.4 Allied believes the CCTV cameras are necessary for legitimate business purposes including:

(a) to prevent crime and to protect our fuel stop sites and fuel stocks;

(b) for the personal safety of our customers and to act as a deterrent against crime;

(c) to support the police in the prevention, detection and prosecution of crime;

(d) to assist in the effective resolution of employment disciplinary matters; and

(e) to assist in defending any claim against us.

7.5 Information collected by our CCTV Systems will only be used and/or disclosed (as applicable) by Allied for the purpose for which it was collected. We will ensure that live feeds from the CCTV Systems are only viewed by approved members of staff whose role requires them to have access to such data.

7.6 We will take all reasonable steps to ensure the personal information collected in accordance with this clause 7 is:

(a) Stored in a way that maintains its integrity and security, as set out in clause 10. Given the large amount of data generated by surveillance systems, data recorded by the CCTV Systems may be stored digitally using a cloud computing system. We will take all reasonable steps to ensure that any cloud service provider maintains the security of our information, in accordance with industry standards.

(b) Held in order to fulfil the purposes for which it was collected, but only for so long as we are legally entitled to do so. Data from CCTV cameras will be permanently deleted once there is no reason to retain the recorded information.

8. Cookies

8.1 Allied uses cookies (being an alphanumeric identifier that we transfer to your computer’s hard drive so that we can recognise your browser) and may use other automated technology (such as usage monitoring software and sessions) in order to monitor your use of the Website and Web Portal, including information about pages viewed, data accessed, depth of historic information accessed, search terms, IP address, browser type and browser language.

8.2 Users may disable cookies by changing the settings on their browser, although this may mean that you cannot use all of the features of the Website and Web Portal.

9. Disclosure of Information

9.1 Unless otherwise expressly authorised to do so by the relevant User or under this privacy policy, Allied will not disclose any User's personal information to any third party except where disclosure relates to the purposes for which the information was collected (as stated in clause 6 above). For the avoidance of doubt, this includes disclosure of information to Mobil where such disclosure is necessary to enable a User to access and use the Web Portal and for any other purposes in connection with a Customer’s MobilCard.

10. Protection and Retention of Personal Information

10.1 Allied will take all reasonable steps to ensure the personal information collected, used or disclosed in accordance with this privacy policy is stored in a secure environment protected from unauthorised access, modification or disclosure.

10.2 We may contract third parties to provide data hosting services, including storage of your personal information. Those third parties may be based in other countries. Appropriate safeguards are put in place to ensure adequate protection of information.

10.3 As Allied’s Website and Web Portal are connected to the internet, all endeavours are made to protect personal information, however Allied cannot provide 100% assurance as to the security of the personal information and cannot guarantee that it will not be intercepted while being transmitted over the internet.

10.4 Allied only retains personal information that is necessary to effectively conduct its operations, provide the Services and comply with all applicable laws and regulations. Reasons for the retention of personal information may include (but are not limited) allowing Allied to:

(a) provide the Services;

(b) comply with applicable laws and regulations;

(c) investigate any complaints; and

(d) protect and/or enforce our legal rights and interests, including defending any claim.

10.5 Allied will hold personal information collected in accordance with this privacy policy only for so long as we are legally entitled to do so.

11. Access to and Updates of Personal Information

11.1 Users may request to see the personal information that is held by Allied on its behalf or to correct or update any personal information.

12. Legal Rights and Access to Personal Information

12.1 Users have the following rights in relation to their personal information:

(a) To request:

(i) access to their personal information.

(ii) a correction to their personal information.

(iii) the deletion or removal of their personal information.

(iv) a restriction on the processing of their personal information.

(v) a transfer or their personal information to you or a third party.

(b) To object to the processing of their personal information.

(c) To withdraw consent to the use of their personal information.

12.2 Users may make a request outlined in clause 11.1 by contacting us at [email protected].

12.3 If a User enforces any of their rights at clause 11.1 that may affect their ability to use the Services.

13. Severability

13.1 If any part of this privacy policy is found by a court to be invalid, void or unenforceable, whether under the Privacy Act or any other applicable law, such provision will be deemed to be deleted from this privacy policy and the remaining provisions of will continue in full force and effect.
